These Terms of Service ("Terms") govern your access to and use of the website located at https://app.brcsend.com/ and the SaaS platform services provided by BRC Send ("we," "us," or "our").

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

1. Description of Service

BRC Send is a social media management and automation SaaS platform that allows users to schedule, draft, and publish content to various third-party social media networks ("Third-Party Services") such as Facebook, Instagram, and others through their official API integration.

2. Account Registration and Security

• To use our services, you must register for an account.
• You agree to provide accurate, current, and complete information during the registration process.
• You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password.
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. User Obligations and Content Rules

You retain ownership of any content (text, images, video) you upload or publish through BRC Send. However, by uploading content, you grant us a worldwide, non-exclusive license to process, store, and transmit this content solely for the purpose of delivering the service.

You agree not to use the service to publish content that:

• Is unlawful, threatening, abusive, defamatory, or invasive of another's privacy.
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software.
• Violates the terms of service, developer policies, or community standards of any Third-Party Services (e.g., Facebook Community Standards).

4. Integration with Third-Party Services

Our service enables posting to Third-Party Services. By using these integrations, you agree to comply with the terms of service of each platform:

We are not responsible for any changes, limitations, suspension, or termination of access to APIs by Third-Party Services that may impact the functionality of our platform.

5. Subscription Fees, Payments, and Refunds

• Certain aspects of the service may be provided for a fee.
• All fees are exclusive of taxes, and you are responsible for payment of all such taxes.
• Subscription billing is processed on a recurring basis (monthly or annually) depending on your selected plan.
• Refund policies are governed by our Refund Policy; payments are generally non-refundable unless required by law.

6. Intellectual Property

The service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of BRC Send and its licensors.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall BRC Send, its affiliates, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service.
• Any conduct or content of any third party on the service.
• Any content obtained from the service.
• Unauthorized access, use, or alteration of your transmissions or content.

8. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
